TERMS AND CONDITIONS

The following Terms and Conditions detail contest rules and prizing for the ‘BE AN ENERGY STAR’ campaign. Participation in this promotion is deemed acceptance of these Terms and Conditions. This promotion is void where it is prohibited by applicable law.

Contest Period: August 30th, 2010 – September 27th, 2010.

Participants must be 18 years old by August 30, 2010 or older, and must be legal residents of the United States.

Employees and their immediate families of the Northwest Energy Efficiency Alliance (NEEA), the Northwest ENEGY STAR Homes program, participating partners, ENERGY STAR builders and agencies associated with this promotion are ineligible to enter.

Only one entry permitted per household. No business or commercial entries will be accepted.

No purchase necessary to enter. Odds of winning are based on entries received.

To enter, complete the ‘BE AN ENERGY STAR – HOME CHECK-UP CHALLENGE’ game board available at participating Puget Sound ENERGY STAR builders and other partner locations. A complete list of participating ENERGY STAR builders and game board partners is available at www.LiveBetterNorthwest.com.

Completed entries must be received by 4:30pm on November 1st. All areas of the game board must be completed and affixed with the appropriate sticker to be eligible for drawing. Mail completed game boards to:

The prize is $10,000 to be issued in the form of a check, written by Fluid Market Strategies, Inc. on behalf of the Northwest Energy Efficiency Alliance’s Northwest ENERGY STAR New Homes program. Winner has the option to accept an additional $5,000 to be used towards the purchase of a new ENERGY STAR qualified home built by a participating ‘BE AN ENERGY STAR’ builder. The $5,000 will be provided directly to the winner’s ENERGY STAR builder of choice, to be used towards the purchase and sale of a new ENERGY STAR qualified home. The $5,000 prize money will be issued to builder upon a mutually accepted offer between the builder and the winner. The winner must close on the property no later than December 31st, 2010.

The winner will be the first entry drawn from all valid entries submitted by the deadline. The winner need not be present to win.

Winner will be notified by Northwest ENERGY STAR Homes in writing within 14 days from the prize draw day. The winner will be notified of their winning a prize by their receipt of a Winner Notification, including an ENERGY STAR Home Purchase Addendum, to be sent by certified, return receipt U. S. mail. The winner will have seven (7) business days from the date of their receipt of the Winner Notification to accept the prize by executing and returning a signed Winner Notification pursuant to the terms stated therein. The winner will have an additional twenty (20) business days to accept the ENERGY STAR Home Purchase Addendum, designating their builder of choice and anticipated offer date. Failure to execute and return the Winner Notification and accept the prize "as is" timely and pursuant to the terms stated therein, will automatically result in forfeiture of the prize, with no substitutions or alternative prize available to said original winner. At that point, a second name will be drawn on a separate prize draw day, and the prize money will be awarded to such runner-up that accepts the prize pursuant to all terms and conditions. Upon execution of the Winner Notification, the winner will pick up the prize check at a location within the Puget Sound area. Prize is not transferable.

NEEA reserves the right to use the names, picture, video images, and relevant quotes of the winner for promotional advertising and/or publicity purposes in any media, now or hereafter known throughout the world in perpetuity and without compensation or prior notice. The winner of the prize in the ‘BE AN ENERGY STAR’ $10,000 giveaway is subject to any and all applicable federal, state, and local taxes payable due to the acceptance of their prize.

DISPUTES: THIS SWEEPSTAKES IS GOVERNED BY THE LAWS OF THE UNITED STATES AND THE STATE OF WASHINGTON, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this sweepstakes, each participant agrees that any and all disputes that cannot be resolved between the parties and causes of action arising out of or connected with this sweepstakes shall be resolved individually, without resort to any form of class action, exclusively before a court located in Multnomah County, Oregon, having jurisdiction. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for and hereby waives all rights to claim punitive; incidental; or consequential damages, including reasonable attorneys’ fees, other than participant’s actual out-of-pocket expenses (i.e., costs associated with entering this sweepstakes), and participant further waives all rights to have damages multiplied or increased.

RELEASE: By acceptance of the prize, the winner releases Fluid Market Strategies, Inc., NEAA, participating builders, the New Home Council, and other participating sponsors from and against any and all liability and claims or causes of action, including, but not limited to, personal injury, death, or damage to or loss of property with respect to all aspects of this Promotion, including those arising out of participation in this Promotion, any prize related activity whether sponsored by Sponsors or third parties, or the acceptance or possession or use/misuse of the prize or any component of the prize.
